Use License

On The Go Map grants you a personal, revocable, non-exclusive, non-transferable license to access and use the services as permitted by these terms. You may not copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder.

Your license shall terminate if you violate any of these terms and conditions or at any time. Upon termination, you must destroy downloaded materials in your possession.

This website and its content, features, and functionality are owned by the operator of the website and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Permitted and Prohibited Uses

You may use the website to:

• View maps and create routes
• Create an account and store routes privately
• Publicly display routes you create with attribution as described below online, in video, and in print

You may not:

• Use the website for any unlawful purpose or the promotion of illegal activities including copyright infringement
• Use the service if you are under the age of 13 or if you are under the age of 16 and live in the European Union or European Economic Area
• Attempt to, or harass, abuse, or harm another person or group
• Attempt to decompile or reverse engineer any part of the service
• Modify, translate, or otherwise create derivative works of any part of the service
• Harvest or scrape any content from the service
• Copy or mirror the materials on any other server
• Access the service by any means other than through the interfaces provided by On The Go Map
• Transmit or post any confidential or proprietary information to the website
• Interfere or attempt to interfere with the proper functioning of the service
• Make any automated use of the system or take any action that we deem to put an unreasonably large load on our servers or infrastructure
• Create multiple accounts to circumvent any service limits
• Attempt to access other users' private route or account data
• Enter someone else's email address to send them an unwanted temporary code
• Bypass any measures we may use to prevent or restrict access to the service

When you share a route via link or embed that route via an iframe or similar technology on a website you must:

• Include a link to onthegomap.com near the embedded route. If you copy/paste the code generated by the website, it handles this automatically
• Obtain legally sufficient consent from users to this website's use of cookies in accordance with our Privacy Policy
• State in your terms of use that your users agree to be bound by these terms of service
• Contact us at info@onthegomap.com if you anticipate over 1,000 daily pageviews

We reserve the right to terminate an account or block access to this website for any user or shared/embedded route that does not comply with these terms.

Account Registration and Security

To create an account, you must provide a valid email address and verify that you own it using a temporary code sent to that address.

You are responsible for maintaining the security of your account and for all activities that occur under your account. You must protect access to devices where you have saved passkeys or active sessions, and notify us immediately at info@onthegomap.com if you suspect unauthorized access. You may not create multiple accounts, share your account with others, or use another person's account without permission.

You are responsible for changing the email address associated with your account if you change your email. If you lose access to the email address associated with your account, then you will not be able to recover access to your account.

Account Deletion and Termination

You may deactivate your account at any time through account settings.

We may suspend or terminate accounts for violations of these terms or to protect the service. Termination may result in immediate loss of access to your stored routes and account data.

Account deletion by you or by us will immediately and permanently delete all account data including stored routes. Any shared or embedded routes saved on your account will no longer be accessible.

All provisions of this agreement survive termination including warranty disclaimers, ownership provisions, indemnity, and limitations of liability.

Inactive Accounts

If you do not access your account for 12 consecutive months, we may delete your account and all stored routes. We will send an email to your registered address 30 days before deletion. Using your account during this notice period will prevent deletion.

Service Limits and Quotas

Free accounts may store a limited number of routes. We may offer paid tiers with higher limits in the future. To protect service stability and account security, we also apply rate limits to route and account-related activities. If you exceed rate limits, you may temporarily be unable to use certain features. You may not create additional accounts to bypass these limits.

We reserve the right to enforce additional limits or suspend accounts that place unreasonable load on our infrastructure, even if within stated quotas.

We may modify service limits at any time. If we reduce limits that affect your existing usage, we will provide reasonable notice before enforcement.

Your Content

When you submit content to On The Go Map (for example, creating a route), you retain ownership of all intellectual property rights over that content.

When you save a route to your account, you grant us a limited, non-exclusive, worldwide license to store, back up, and display that route to you. This license is only for operating the service and terminates when you delete the route or your account. This route is private and only visible to you unless you choose to share it publicly.

When you create a link to share a route, you grant a non-exclusive, worldwide, royalty-free, sublicensable, transferable right and license to use, copy, display, distribute, and publish that content. Shared routes cannot be deleted after sharing unless they were saved to your account, in which case you may revoke public access or delete them at any time.

All saved routes, including shared routes, are deleted immediately upon account termination. Shared routes not saved to your account may continue to be accessible.

Data Export

You may export routes including those saved on your account in GPX format at any point. We make reasonable effort to maintain compatibility, but we do not guarantee that exported routes will be compatible with all third-party applications or devices.

Third-Party Services

This website uses third-party services to deliver functionality, including APIs provided by Google, Inc. like Google Drive API. By using the website, you agree to Google's Terms of Service. We use Amazon Web Services (AWS) including Simple Email Service (SES) to send automated account-related emails and by using account features, you agree to AWS Service Terms. We also use APIs provided by Stadia Maps and Esri and by using this website you agree to Stadia Maps Terms of Service and Esri's Terms of Service. You also agree to the privacy policies of the third party services listed in our Privacy Policy.

Advertising

We use Google Adsense to display advertisements from Google and other advertising networks on our website for which we are compensated. We do not endorse any products or services advertised on this website nor provide any guarantee about their availability. You may opt-out of personalized advertising through Google's ad network by visiting Google's Ad Settings. We do not sell personal information as defined by the California Consumer Privacy Act.

This website may contain links to other websites. We are not responsible for availability or content of these outside resources. Use of any linked website is at your own risk.

Disclaimer of Warranties and Liability

Your access to and use of this website are at your own risk. The materials are provided on an 'as is' and 'as available' basis. We make reasonable effort to maintain backups, but do not guarantee successful data recovery. You are responsible for maintaining your own backup copies of important routes. We are not liable for any loss of account data, stored routes, or inability to access your account for any reason.

In no event shall we or our suppliers be liable for any damages (including, without limitation, physical harm or death, damages for loss of data or profit, or due to business interruption) arising out of the use of or inability to use the materials on the website, even if we have been notified orally or in writing the possibility of such damage.

Accuracy and Availability

The materials on this website may contain errors and the site may be unavailable from time to time. Stored routes or account data may be unavailable during outages or maintenance. Account data is not guaranteed to be preserved indefinitely. We do not warrant that any materials on this website are accurate, complete, or current. We may change the materials on this website without notice and we make no commitment to maintain or update the materials.

Activities Waiver

The website may be used in connection with physical or other activities in an outdoor or recreational environment. By engaging in those activities, you acknowledge that these activities carry inherent risks including possibility of violating laws, injury, disability, and death. You also acknowledge that additional risks and dangers may be caused by negligence of On The Go Map, its contractors, suppliers, licensors, and their contractors including but not limited to routes going through private land, routes that are not suitable for such activity, or routes are at a different elevation than the website indicates. By using this website in connection with such an activity, you release and agree to hold harmless On The Go Map, its contractors, suppliers, and licensors from any and all liability associated with your participation in these activities whether caused by negligence or otherwise.

Indemnification

You agree to indemnify and hold harmless On The Go Map, its contractors, and licensors, and their contractors from any and all claims and expenses including attorneys' fees arising from content you store in your account or share publicly, unauthorized access to your account, or use of the website even if use does not comply with these terms.

Modifications

These terms of service may change from time to time. Notice of any change to these terms will be provided on this page. By using this website you agree to be bound by the then current version of these terms. If you do not agree with any changes to these terms, you may no longer use the service.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the federal laws of the United States of America and the laws of the State of Massachusetts without regard to conflict of law provisions.

Severability

These terms of service are the entire agreement between you and On The Go Map and supersede all other communications and proposals. If any provision of these terms is found to be unenforceable or invalid, that provision will be eliminated to the minimum extent necessary so that the remainder of these terms of service will otherwise remain in full effect and enforceable.
